Discusses whether parents who give false information on school application forms to secure their child a place in an educational institution outside their catchment area commit a criminal offence. Examines when such conduct incurs criminal liability, the potential statutory bases for conviction, the political dimension to the issue and whether the rationale used in two cases to distinguish criminal from non-criminal conduct is incoherent. Considers the possible alternatives to prosecution.
