Abstract

Had the Fraud Act been drafted too widely?
Argues that the Fraud Act 2006 wrongly exposes the writers of untruthful or negligent references to possible criminal prosecution. The Act makes giving a bad employment reference a criminal offence. However, commentators have criticised the Act for being too widely drafted and criminalising untruthful statements, which traditionally would have given the victim a course of action in tort.
